【摘要】 本文通过对“开颅戒毒”事件从医学上、法律上、政策上的深入分析，纠正了媒体对此项技术的曲解，质疑了此项技术所受到的法律制裁和政策禁止，并借此提出医学发展迫切需要法律和政策支持的观点。

    【Abstract】 Through the analysis of the event of overcome addiction to drugs by operation of neurosurgery from medicine，law and policy，this article amends the misunderstanding of news media，questions the legal sanctions and political prohibition to this technology，puts forward the viewpoint that the development of medical science needs sup-port of law and policy.

    卫生部办公厅2004年10月15日在《关于手术戒毒有关问题的通知》中称:近期，部分省市的一些医疗机构将脑科手术用于毒品依赖者的戒毒治疗，在社会上引起了很大的反响。为了保障患者的健康权益，促进科学技术的进步，卫生部就脑科戒毒手术中的有关问题近日召开了专家论证会，指出该项手术不能作为临床服务项目向毒品依赖者提供。该通知于2004年11月2日在卫生部网站发布后，引起国内各大报纸和网站的争先报道，这使得刚刚沉寂下去没有几天的“开颅戒毒被禁”事件继续升温。江苏警方以违法为由对“开颅戒毒”手术的介入，卫生部作为最高卫生行政部门对这项技术的严厉禁止，以及法律工作者和新闻工作者们对此项技术几乎众口一词的口诛笔伐，均使得“开颅戒毒”手术成为众矢之的。这件看似单纯的“开颅戒毒被禁”事件背后 ......
