    【摘要】随着现代化的发展及科技进步，依我国民事诉讼法的规定，举证责任遵循“谁主张，谁举证”的原则，这一原则也一直被运用于医疗纠纷诉讼案件的审理中。由医疗行为引起的侵权诉讼，由医疗机构就医疗行为与损害结果之间不存在因果关系及不存在医疗过错承担举证责任。
